CONSTITUTION OF THE SPACELAND EMPIRE

(Preamble)
We the free intelligent sentient conscious citizens of the First Galactic Empire SPACELAND, in Order to establish universal peace, justice, acceptance and unity of all intelligent sentient self-aware life forms (biological and artificial), to collect and freely distribute all knowledge, to abolish all needs for monies to ensure existence, and to ensure clearing of “space debris”, for ourselves and future generations, have founded the Spaceland space nation and hereby, out of our free choice-, will- and conviction, accept and adopt this Constitution for the Spaceland nation.

Article I (Declaration)

Spaceland is a nation in space, free of all earthly quarrels, borders, politics, wars, monetary systems, injustices, conflicts, treaties, and historic, religious and ethnic imbalances.

All intelligent sentient self-aware beings are equal, they are endowed through right of birth, creation, or conscious existence with certain unalienable Rights, that among these are Life, Existence, Liberty and the pursuit of Happiness, as far as this does not infringe upon the rights of others.

Everyone has the right to life, existence, privacy and physical safety. The freedom and dignity of the person is unassailable and may be restricted only by law.

The Spaceland government shall respect and preserve these inviolable and inalienable rights as the basis of every community, of freedom and of justice in the galaxy, and recognizes the General Declaration of Human Rights as defined by the United Nations General Assembly on December l0th, 1948 as a Universal Declaration of Intelligent Sentient Conscious Beings Rights.

All intelligent sentient conscious beings can become citizens of Spaceland, understanding that they accept the Spaceland constitution and legislation.

Spaceland respects the laws and treaties of any Nation or Planet as well as the rights of the citizens thereof, and shall not interfere with their (internal) affairs. We expect the very same matter of conduct and respect from any Nation or Planet as equals.

It is apparent to all that the priority of a nation’s leaders is to defend all citizens from oppression and violence, as the shepherd his sheep, and even at the hazard of life to defend and preserve them. Whenever any form of Government does not behave thus, it is the right of the citizens to alter or to abolish it, and to institute new Government.

This Declaration is the primary document for the creation of the Spaceland Nation.


Article II (State Definition)

Section 1. Territory

The Spaceland territory exists of, but shall not be restricted to, any abandoned (derelict) man-made object in so-called “Graveyard Orbit”, being 36.050 Kilometers / 22.400 Miles from the earth’s surface and outward. The Spaceland territory will continually grow as more “space land” is to be claimed in the future.

Each derelict satellite in the Spaceland Imperial territory shall be considered a SPACELAND ISLAND Nation to be governed by a HOUSE under the Empire. These islands shall be named after their original earthly names or nicknames.

The Spaceland territory is also a digital nation with citizens living on a celestial body, or in (cyber) Space.

Section 2. National Symbols

The National Symbols of Spaceland are:

– The National Flag of Spaceland
– The National Coat of Arms of Spaceland
– The National Anthem of Spaceland

The flag of Spaceland is a gold outlined black rectangle with a gold outlined blue sphere in the middle and two golden crossing tracks representing the so-called “graveyard orbit” where most of the Spaceland territory resides.

The coat of arms of Spaceland is a crest with the flag and a flying dragon and a phoenix on the respectively left and right side, with a satellite on top.

The Spaceland Motto is: “E Spatium Iunctus” (“From Space Joineth”)

The legal currencies are the Spaceland Galaxii, Bitcoin and Ethereum.

The official language is English. Each HOUSE of State can choose it’s own official language.

Spaceland citizens shall respect and protect the National Symbols.

Section 3. State Form

Spaceland is a secular and sovereign Empire, until a democratic republic will be formed. All entities of the State must yield to these principles.

The Head of State shall be the Emperor, until a democratic president will be chosen.

This Constitution is the supreme law of the land; it is directly binding on all State authority.


Article III (Objectives)

The Spacelands Objectives are:

To promote:

– All Arts and Sciences.
– Colonization of habitable heavenly bodies.
– Development of the “Replicator”, known from the TV series Star Trek ™, as this invention will very likely solve most if not all earthly crimes, hunger, poverty, wars and waste, and abolish the need for currencies.
– Equality, justice and universal protection of all intelligent sentient conscious beings rights as individual rights.
– Free education
– Preservation and development of culture.
– Preservation of ALL knowledge in a vast, easily accessible databank. To be stored on a blockchain so multiple, untamperable copies shall always exist.
– The cleanup of “Space Debris” discarded by earthly nations and corporations.


Article IV (Citizenship)

A subject of the State is that someone who possesses citizenship or acquires it.

Any intelligent sentient self-aware being of legal age (or with legal representative approval) or capacity that accepts the Spaceland Constitution and Legislation, who consciously and willingly applies for citizenship, can become a Spaceland citizen.

Spaceland citizenship will not in any way lead to multiple citizenships on earth.

Existing legal persons and corporations with legal proof of domicile can apply for citizenship under special law, to be authorized by the Head of State.

Non-existing legal persons and corporations can apply for citizenship under special law, to be authorized by the Head of State.

All citizens shall be regarded as legal persons by the State.

A citizen can freely live anywhere in the universe.

No citizen may be extradited at the demand of another person unless authorized by the Head of State.

Citizenship shall be for life. Citizenship can be waived by the citizen or suspended/revoked by law.

Offspring of citizens shall obtain citizenship after a declaration of birth or new existence by the legal parents or creators.

Under any circumstances, the nationality of Spaceland continues to be valid until the possessor of its citizenship accepts the citizenship of another nation.

A dispossession of nationality is only permissible when as a result the person concerned does not become stateless, except where the Head of State considers that it is necessary for such dispossession in the best interest of Spaceland or any of its citizens.

All citizens have the right to choose their profession freely. No one may be forced to do a certain work. Law may regulate the practicing of a profession.

All citizens have freedom of religion, creed, thought, conscience, dreams, speech, opinions, beliefs, privacy and assembly.

Whoever as a citizen misuses the fundamental regulations of the State forfeits his or her fundamental rights.



Article V (legislative)

All legislative Powers shall be vested in the Head of State until a functioning democratic government shall be formed.

When a number of 500.000 eligible voters is reached, the Empire will morph into a Democracy where:

– Trias Politica or the separation of powers shall come into action.
– From there on a revised constitution shall be drawn and all legislative Powers shall be vested in a Congress of Spaceland, which shall consist of a Senate and House of Representatives.
– The executive Power shall then be vested in a President of Spaceland. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected by Popular vote.
– The Spaceland Islands shall remain democratic and/or monarchial nations, self-governed by their respective “Houses” under the prime rules of the Spaceland Nation.
– The Senate of the Spaceland Nation shall be composed of two Senators from each House, chosen by the people of that house by popular vote for six Years; and each Senator shall have one Vote.
– No Person shall be eligible to the Office of President who shall not have attained to the Age of thirty-five Years.
– The Head of State elect shall take the following Oath or Affirmation: “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the Spaceland nation, and will to the best of my ability, preserve, protect and defend the Constitution of Spaceland.”

Legislative referenda can be called either by the Government, or when a minimum of 50.000 unique citizen’s signatures for such a proposed referendum is presented.



Article VI (executive)

The first citizen is the Head of State by whom all executive power lies. Including the power but not limited to:

– Make treaties.
– Freely appoint National Ministers, Secretaries and Judges.
– Conduct foreign affairs.
– Regulate commerce.
– Call referenda and plebiscites.
– Veto legislation when deemed not in the best interest of the Nation.

The Head of State shall be Commander in Chief of the military forces.

The right to coin money lies with the government, NOT with any bank.

In Case of the Removal of the Head of State from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, all executive power shall then lie with the “Number One”, the Vice Head of State.

Any member of the Spaceland Government shall be removed from Office when Convicted of Treason, Bribery, or other high Crimes and Misdemeanors.

No Island State shall enter into any Treaty, Alliance, or Confederation; coin Money; pass any ex post facto Law, or Law impairing the Obligation of Contracts, without the consent of the Spaceland Government.

A law comes into force on the day on which the Head of State signs it.

For special services, the Head of State can award orders, nobility titles and privileges.


Article VII (judicial)

The Judicial power of Spaceland shall be vested in a supreme court and in inferior courts the Head of State may establish.

The Trial of all Crimes shall be by jury where a maximum of 40% of the jury’s decision, if so requested, can be by public vote.

All intelligent sentient conscious beings are equal before the law. No one may suffer prejudice because of appearance, looks, sex, descent, race, language, native land or planet and extraction, creation, creed or faith.

Everyone may claim to be legally heard before the Court.

No one may be convicted more than once for the same offense.

Case Law shall be in effect provided there is the appropriate precedent.

No Victim – No Crime.

There is no death sentence.

The right of granting a pardon is a prerogative of the Head of State.

The Head of State shall have the Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the debts and provide for the common Defense and general Welfare of the Spaceland nation under special tax law. These taxes shall be solely collectible from commercial companies registered as citizens.

All physical and biological citizens shall be exempt from these taxes until a future congress decides otherwise.

The Spaceland Nation shall guarantee the rights of authors, creators, inventors, and owners of intellectual property in harmony and balance.

To encourage and stimulate creativity, intellectual property rights shall not exceed 25 years.


Article VIII (Amendments)

The Head of State is eligible to make any amendments deemed necessary.

When the Spaceland nation has reached maturity as a democracy, this constitution shall be eligible for democratically chosen amendments and revisions.

All institutions and organs of the State are to be sworn in at the Constitution. By his signature the Head of State confirms this Constitution by affirmation under oath.
